Forestry checking for Quad insurance

Forestry guys were out last weekend checking people for insurance on their quads when they drive on FSRoads. Apparently they are going to start enforcing it and helmets too. It will apply to quads, dirt bikes, snowmobiles. Just a heads up, they hired a bunch of Forestry students for the summer and this has always been on the books but now they are going for it.

the helmet one you could fight because that was written and placed in effect prior to quads so if you go look it up you will see that it only applies to Bikes and Trikes (unless it has been amended).
The insurance thing is liability insurance in case a quad hits someone etc

If you don't buy it through ICBC then who are you buying it from? Everyone i know with a quad that bought that insurance got it from ICBC or one of the insurance shops around town who all insure through ICBC. Maybe if you live in Alberta you can get it from a Private insurance place but here in B.C. only place Company i know for insurance is ICBC.

My insurance is through my Fish and game club . it is only valid if i am engaged in hunting or fishing related activities (you can always be scouting for fishing or hunting) .
but you can also get Capri as well as a few other i think. Go to an ATV site and you can get the info.

They are going with the Motor Vehicle Act in regards to the helmets and all. ICBC up here is just confused, they were not ready for this they said. You have to have a minimum 200,000 liability and from what I can find out here thru ICBC it's about $165/year.
The forestry guys said last weekend they are cruising campsites and FSRoads and will start fining people soon. This is seriously messed up, you have to carry the insurance but no plate or anything so they will pull you over often. They said they will also be watching for impaired drivers, people with no driver's license can't drive anything on a FSRoad so much for taking your kids out for a day quadding, biking or snowmobiling . They are going to follow the MVA so that opens a whole new world of shit, undue care and attention, speeding, dangerous driving, etc.... All bad news.

again...... to our shit government

Not even close . You are confuseing actual rights with perceived rights

Of course they create laws and enforce them .

As for Canadian Constituition (where should i start) it is not withstanding so in effect any perceived right in canada can be ignored by the powers that be if it is felt to be in the publics interest ( the governments at least) .

We dont have truely inalienable rights nor do we have any property rights in Canada so if the Gov decided that quads were too dangereous they could take them away for the publics own good and they would not have to compensate you a nickle for it.

as for insurance? that has been on the books for ages thanks to the NDP, but it is only recently that it is being enforced

as for the MVA section 221 covers helmet use which only specifys only MC as needing them
Motorcycle safety helmets

221 (1) A person who operates or rides as a passenger on a motorcycle without properly wearing a motorcycle safety helmet commits an offence.
(2) For the purposes of subsection (1), a helmet that has, by regulations that may be made by the Lieutenant Governor in Council, been designated as an approved motorcycle safety helmet, is deemed to be a motorcycle safety helmet.
(3) The Lieutenant Governor in Council may make regulations exempting any person or class of persons from the requirements of this section and prescribing conditions for those exemptions

Definitions list a MC as a 2 or 3 wheeled vehicle

"motorcycle" means a motor vehicle that runs on 2 or 3 wheels and has a saddle or seat for the driver to sit astride;

They dont seem to have a listing in the act for ATVs

now there is an ATV act but i dont recal seeing the helmet requirment there but it could be. Very often an officer will hand out a ticket even if it is incorrect and the onus is now on you to prove it does not apply. 99% of the time folks will pay it because it is easier.

i think the insurance is a good thing. i need someone to sue when i hit one of them wile they are on the wrong side of the road around a corner racing on the FSR. but $400 is high for sure, but $145 a year seems fair.
